Many people still don't know the conditions for heirs to receive a retirement benefit if they die, Section 33 - Section 39.

 


Benefits In case of death For insured persons under Section 33 and Section 39, if the insured dies, the heir will receive 3 rights: welfare money, old age pension and funeral expenses. The insured person will receive the rights when they have paid contributions for at least 1 month within 6 months before the death.

Old age pension If the insured person dies

The heir will have the right to receive the old age pension back to the eligible heir, which is a legitimate child, legal husband or wife, parents who are registered as married. If not registered as married, only the mother or other persons who the insured person has written to receive it together with the eligible heir.

1. The insured person has requested a pension before death.

- In the case that the insured person has received an old age pension and dies within 60 months from the month of receiving the pension, the heir will receive a pension equal to the amount of the old age pension for the last month before death x the number of months remaining until 60 months have passed.

- In the case that the insured person returns to being an insured person and later dies Received a pension for no more than 60 months, the heir will receive a lump sum equal to the amount of the old-age pension received before returning to being an insured person x the amount of salary remaining until 60 months

- In the case of receiving the old-age pension before the enforcement of the ministerial regulation but not yet 60 months, the heir will receive a lump sum equal to the months remaining until 60 months

- In the case of receiving the old-age pension and having less than 10 months remaining, the heir will receive a lump sum equal to the amount of the old-age pension received in the last month before death, 10 times

2. Insured persons under Section 33 and Section 39 who die before the age of 55

The heir who is entitled to receive the old-age pension as specified by the Social Security Act is not entitled to receive the pension. Even if contributions have been made for 15 years, eligible heirs can request a refund for old age benefits within 2 years.

Funeral expenses for insured persons under Section 33 and Section 39

The Social Security Office pays funeral expenses to the funeral director in the amount of 50,000 baht.

Who is the funeral director?

- A person whom the insured person has written to be the funeral director and has become the funeral director of the insured person.

- A husband, wife, father, mother, or child of the insured person who has evidence showing that they are the funeral director of the insured person.

- Other persons who have evidence showing that they are the funeral director of the insured person.

Evidence required for filing a request for funeral expenses

- Death Benefits Application Form (SSO 2-01)

- A copy of the funeral director's national ID card with the original document

- Evidence from the crematorium or mosque showing that they are the funeral director

- A copy of the death certificate with the original document

- A copy of the first page of the savings account passbook with the name and account number (in the case of requesting money via the bank) via the funeral director's bank account.

Welfare in the event of death of an insured person under Section 33 and Section 39

Welfare in the event of death of an insured person is paid only to persons who have been specified in a letter by the insured person as being entitled to receive the welfare money.

However, if the insured person does not specify in a letter, the amount shall be distributed equally to the insured person’s spouse, parents, or children as follows:

- Insured persons who have made contributions for at least 36 months but less than 120 months shall be paid an amount equivalent to 2 months’ average salary.

- Insured persons who have made contributions for at least 120 months shall be paid an amount equivalent to 6 months’ average salary.

Documents required for applying for welfare money

- Application form for death compensation (SSO 2-01)

- Copy of the national ID card of the person entitled to receive welfare money

- Copy of the marriage certificate of the insured person and the insured person’s parents (if any)

- Copy of the child’s birth certificate or copy of the child’s house registration if there is no birth certificate

- Letter specifying the person entitled to receive the welfare money in the event of death (if any)
